This Privacy Policy explains how StepShake Social Technologies Inc. (“StepShake,” “we,” “our,” or “us”) collects, uses, shares, stores, and protects information when you use the StepShake app, StepN’Talk companion messaging app, websites, services, subscriptions, rewards, clubs, events, messaging, live streaming, and related features.

1. Information We Collect

StepShake collects certain information in order to operate the app, maintain security, process payouts, and provide core features such as walking tracking, Step Clubs, groups, rewards, messaging, live streaming, business check-ins, and event coordination. The information we collect depends on how you use StepShake and the permissions you choose to grant.

1.1 Personal Information

We collect the personal information you voluntarily provide when creating or updating your account, or when interacting with the app.

This may include:

  • Full name
  • Email address
  • Phone number for verification and security
  • Profile photo or avatar
  • Date of birth, where required for age verification
  • Country or region of residence
  • Username or display name
  • Account preferences and settings
  • Club IDs, club invitations, membership records, and content-purchase records
  • Step Club profile and role, such as owner, admin, or member
  • Business listings you create as a Pro user
  • Photos, videos, live highlights, or other media you upload
  • Camera or microphone data when you choose to capture ID documents, live streams, videos, or highlight clips

If you choose to sign up using Apple, Google, or other social login providers, we may receive basic profile information such as name, email address, and profile picture from those platforms.

We do not access your device’s contacts, photos, camera, microphone, or files unless you explicitly choose to grant permission for a specific feature.

1.2 Activity Data

To provide core StepShake features such as walking analytics, rewards, Step Clubs, community participation, and social features, we collect data related to your activities within the app.

This may include:

  • Steps, walking duration, distance traveled, workouts, and related activity metrics
  • Participation in groups, Step Clubs, group paths, challenges, local meetups, or events
  • Step Club membership, club roles, posts, live sessions, group paths, and highlight media
  • Business check-ins, visit ratings, and partner activity where available
  • Club content purchases, club-owner balances, withdrawal activity, and payout history
  • Events you create or join
  • Invitations you send or receive
  • Your interactions with friends, nearby users, clubs, businesses, or event participants
  • Messages you send within the app or StepN’Talk, securely stored and encrypted in transit
  • Live stream participation, including audio or video when you choose to go live
  • Club membership activity, member-fee activity, club-owner support payouts, and content purchase history
  • In-app actions, such as opening screens, tapping menus, connection history, feature usage, and app navigation

With your permission, StepShake reads step and activity data from Apple Health, including steps, distance, workouts, and related metrics. With your permission, we use device location for Discover map groups, group paths, meetup pins, business check-ins, nearby friend features, and location-based recommendations.

We do not access your device’s health data, GPS data, fitness app data, camera, or microphone unless you grant permission.

1.3 Device & Technical Data

To maintain app performance, security, analytics, and quality control, we automatically collect standard device information.

This may include:

  • Device type, such as iPhone or Android model
  • Device operating system and version
  • App version
  • IP address and general location derived from IP
  • Device identifiers, such as IDFA or GAID, where permitted
  • Crash logs and diagnostics
  • Error reports, screen load times, and performance events
  • Network type, such as WiFi or cellular
  • Security logs for fraud detection

This data helps us troubleshoot issues, prevent abuse, ensure app stability, and improve the user experience.

1.4 Financial & Identity Verification Data

StepShake does not store or have access to your full financial information.

We use secure third-party providers:

Plaid – Identity Verification

Plaid may be used for:

  • Confirming your identity
  • Confirming bank account ownership for payout eligibility
  • Fraud prevention and regulatory compliance

Plaid securely connects to your financial institution. StepShake never receives or stores your bank username, password, full account number, routing number, or bank login credentials. We only receive verification status, legal name confirmation, tokenized verification data, payout eligibility confirmation, and fraud-prevention indicators.

Stripe – Payments, Subscription Billing & Stripe Connect

Stripe may be used for:

  • Processing credit card transactions for web billing
  • Managing subscriptions
  • Billing, invoices, refunds, and chargebacks
  • Processing eligible club-owner, creator, and content-sale payouts through Stripe Connect

For eligible club-owner support payouts, creator payouts, and content-sale payouts, we use Stripe Connect to transfer eligible balances to your linked account. StepShake receives payout status and limited account metadata, but not your full banking credentials.

StepShake does not see or store full card numbers, CVV codes, full bank account numbers, or bank login credentials.

Apple In-App Purchases

Apple In-App Purchases may be used for iOS purchases and subscriptions. Apple handles payment processing, subscription billing, renewals, refunds, and App Store payment data. StepShake never receives your Apple payment details.

1.5 Tax Information: W-9 & International Compliance

If you participate as a club owner, creator, seller of club content, or receive payouts from StepShake, we may be required by law to collect certain tax information depending on your country.

United States

If your earnings meet IRS thresholds, we may collect:

  • W-9 forms
  • Legal name
  • Address
  • Tax classification
  • TIN or SSN only if legally required

We do not store raw SSN numbers directly in the app database. We store only the minimum required values for reporting and compliance.

Canada

We do not collect Social Insurance Numbers unless legally required. We may collect legal name, address, and residency status if required for payout eligibility or compliance.

United Kingdom

We do not collect National Insurance Numbers unless legally required. We may collect full name, address, residency confirmation, and proof of taxable status if required for payouts.

Other International Users

For users outside the U.S., UK, and Canada, we may collect minimal legal information necessary to determine tax residency, process payouts, and comply with anti-fraud or regulatory requirements.

We do not collect passport numbers, driver’s license numbers, full SIN or NIN numbers, or non-essential sensitive personal data unless local law explicitly requires it.

1.6 Information from Third-Party Accounts

If you connect StepShake with external platforms such as Apple, Google, or social media accounts, we may receive:

  • Name
  • Email address
  • Profile picture
  • Authentication tokens

We do not access your private content on those services.

1.7 Information You Provide Voluntarily

This includes:

  • Feedback submitted through forms or surveys
  • Messages sent to customer support
  • Content posted inside groups, clubs, paths, highlights, events, or community features
  • Suggestions or beta testing notes
  • Photos, videos, live highlights, or media you choose to upload

We only store what you intentionally submit.

1.8 StepN’Talk Companion App

StepShake integrates with StepN’Talk, our companion messaging app. If you use both apps with the same account, we may sync profile identifiers, account status, friend connections, group identifiers, message metadata, and other information needed to deliver chat and social features.

StepN’Talk’s use of message content, profile data, and account information is governed by this Privacy Policy and the applicable StepN’Talk terms.

2. How We Use Your Information

StepShake uses your information to operate, maintain, secure, and improve the Service. We only use your information for legitimate business purposes, and we do not sell your personal data.

2.1 To Provide and Maintain Core App Functionality

We use your information to:

  • Create and manage your StepShake account
  • Enable walking, activity tracking, and progress reporting
  • Support group participation, Step Clubs, club membership, group paths, highlights, invitations, and messaging
  • Operate Step Clubs, live streaming, and video store features
  • Allow you to join events or meetups
  • Calculate club-owner support payouts, creator revenue, content purchases, and eligible club-related balances
  • Process club-owner revenue, member fees, video/content sales, and eligible payouts
  • Store your preferences and app settings
  • Sync your data across sessions and devices

This data is required to operate the core features of the StepShake app.

2.2 To Verify Identity and Prevent Fraud

We use Plaid and other security tools to verify identity, confirm account ownership, and ensure payout eligibility. We may use your information to authenticate your identity, confirm eligibility for club-owner, creator, or content-sale payouts, prevent duplicate or fraudulent accounts, detect suspicious behavior, and protect StepShake and other users from misuse.

2.3 To Process Payments, Subscriptions, and Transactions

We use your information to process payments through Stripe, manage billing cycles and subscription renewals, handle Apple In-App Purchase transactions, generate receipts, maintain purchase records, deliver paid features, and process eligible payouts through Stripe Connect. We do not store your full credit card or bank details.

2.4 To Calculate, Issue, and Report Club-Owner Earnings & Tax Documents

If you participate as a club owner, creator, seller of club content, or receive payouts through StepShake, we may use your information to track membership activity, calculate monthly club-owner support payouts, process video/content sales, verify payout eligibility, issue required tax forms, meet international tax compliance obligations, and maintain records required by law.

2.5 To Improve App Performance and User Experience

We use analytics, device data, crash reports, and behavior information to identify bugs, improve reliability, optimize features, understand app usage, and develop new features.

2.6 To Personalize Content and Recommendations

We may use activity data, location data where permitted, and app interactions to suggest groups, Step Clubs, businesses, events, people near you, activity insights, reminders, and relevant notifications.

2.7 To Communicate With You

We may contact you to send account notifications, payment confirmations, renewal notices, identity verification updates, support responses, promotional messages, product updates, and feedback requests. You may opt out of marketing communications at any time.

2.8 To Maintain Safety, Security, and Legal Compliance

We use your information to detect security breaches, enforce community guidelines, address harmful behavior, investigate fraud, comply with laws, and respond to lawful requests.

2.9 To Enable Social, Group, Club, Messaging, and Community Features

We use your information to support messaging, StepN’Talk, Step Clubs, group participation, invitations, user profiles, activity sharing, event coordination, live streaming, highlights, and meetup features.

2.10 For Internal Reporting and Administration

We may use aggregated or anonymized data for analytics, performance metrics, business reporting, internal monitoring, audits, compliance reviews, and product planning. This data cannot be used to identify individual users.

3. Plaid, Stripe & Apple Data Usage

StepShake integrates with trusted third-party providers to deliver secure identity verification, payment processing, payout processing, and subscription management. These providers operate under their own privacy policies and security frameworks.

3.1 Plaid: Identity & Bank Verification

StepShake uses Plaid to securely verify your identity and confirm account ownership when required for club-owner payouts, creator payouts, content-sale payouts, fraud prevention, or regulatory compliance.

Plaid may collect account ownership details, account type and status, tokenized account information, and other verification-related information directly from your financial institution. StepShake does not receive your banking username, password, full account numbers, or financial login credentials.

3.2 Stripe: Payments, Billing, Subscriptions & Stripe Connect

StepShake uses Stripe as its primary payment processor for non-Apple transactions, including web billing, certain subscriptions, invoices, refunds, disputes, and eligible payouts through Stripe Connect.

Stripe may process payment card information, billing address, subscription history, invoices, receipts, refunds, dispute information, transaction logs, payout account information, and limited compliance data. StepShake receives tokenized payment IDs, subscription status, billing events, payout status, and limited customer or connected-account metadata.

StepShake does not receive full card numbers, CVV codes, full bank account credentials, or bank login credentials.

3.3 Apple: In-App Purchases & Subscriptions

For users on iOS, StepShake uses Apple’s In-App Purchase system for subscription payments made through the App Store. Apple manages payment processing, subscription billing, automatic renewals, refunds, and App Store payment information.

StepShake receives transaction receipts, subscription activation or expiration status, refund status, product ID, plan type, and renewal status. StepShake does not receive your Apple billing address, credit card numbers, debit card numbers, Apple ID password, or Apple payment details.

4. International Users & Tax Reporting

StepShake may offer club-owner support payouts, creator earnings, content-sale payouts, and other earning features that may be considered taxable income in certain jurisdictions. Tax laws vary by country and region. Users are responsible for understanding and complying with their own legal obligations.

4.1 United States

For U.S.-based users, creator earnings, club-owner support payouts, content-sale revenue, and similar earnings may be considered miscellaneous income by the IRS. StepShake may request a W-9 form, collect legal name and taxpayer information, track annual earning amounts, and issue a Form 1099-NEC or 1099-MISC if earnings meet applicable IRS thresholds.

Failure to provide required tax information may result in withheld payouts, payout feature restrictions, account suspension for payout-related features, or backup withholding where required by law.

4.2 Canada

Canadian users may earn taxable club-owner, creator, or content-sale income depending on the total amount received during the year. StepShake does not issue T4A, T5, or other CRA tax slips unless legally required. Users are responsible for reporting income to the Canada Revenue Agency. StepShake may request basic residency information but does not request a Social Insurance Number unless legally required.

4.3 United Kingdom

UK residents may be required to report certain earnings under HMRC rules. StepShake does not issue UK tax documents such as SA100, P60, or P45 unless legally required and does not collect National Insurance Numbers unless legally required. Users must track their own earnings and report income where applicable.

4.4 European Union, EEA & Global Regions

For users outside the U.S., Canada, and UK, StepShake does not issue localized tax documentation unless legally required. Users are responsible for reporting earnings under their own country’s tax regulations. StepShake may request limited legal information to comply with anti-fraud, anti-money-laundering, or payout regulations.

4.5 Tax Document Storage & Security

StepShake stores only the minimum information legally required for tax compliance. Sensitive tax documents are encrypted and protected. We do not share tax information except when required by law, required to issue tax forms, or necessary to comply with regulatory obligations.

4.6 Eligibility & Payout Limits

StepShake may restrict payouts for users who do not provide required tax information, limit payout amounts based on region-specific regulations, and suspend accounts that provide fraudulent tax information.

5. Sharing of Information

StepShake does not sell your personal data. We only share information when necessary to operate the Service, comply with the law, process payments and payouts, prevent fraud, or protect users.

5.1 Service Providers

We work with vendors who help operate and improve the app. These may include hosting providers, cloud storage providers, analytics platforms, customer support tools, communication providers, identity verification services, payment processors, payout processors, fraud prevention tools, and crash-reporting platforms.

Service providers may access information only to perform work on our behalf and must follow confidentiality and security obligations.

5.2 Payment & Identity Verification Partners

We share limited information with Plaid, Stripe, Stripe Connect, and Apple App Store only as needed to verify identity, process payments, manage subscriptions, issue club-owner or creator payouts, process content purchases, handle refunds, process disputes, or comply with legal obligations.

5.3 Community, Club & Social Features

When you participate in groups, Step Clubs, paths, events, live streams, highlights, business check-ins, or social features, certain information may be visible to other users, including your name or display name, profile photo, step activity where shared, group paths, event participation, posts, comments, live content, purchased or uploaded content, messages you choose to send, invitations, and club role.

5.4 Legal, Regulatory, and Safety Requirements

We may disclose information to comply with applicable laws, subpoenas, legal processes, law enforcement requests, fraud investigations, safety concerns, regulatory obligations, or policy enforcement. We will only share the minimum information reasonably necessary.

5.5 Business Transfers

If StepShake is involved in a merger, acquisition, restructuring, financing, asset sale, or similar transaction, your information may be transferred as part of the business assets. Where required by law, we will provide notice.

5.6 With Your Consent

We may share information for purposes not covered above only when you authorize it, such as connecting StepShake to another service, sharing activity to social media, or participating in optional promotions or surveys.

5.7 Aggregated or De-Identified Information

We may use and share aggregated, anonymized, or de-identified data that cannot reasonably be used to identify you. This may include app usage trends, step activity statistics, community metrics, club metrics, and performance data.

6. Security

StepShake takes privacy and security seriously. We implement administrative, technical, and physical safeguards designed to protect information from unauthorized access, misuse, loss, or disclosure. No system can guarantee complete security, but we work to maintain industry-standard protections.

6.1 Technical Safeguards

  • Encryption in transit using HTTPS/TLS 1.2 or higher
  • Encryption at rest where supported by hosting platforms
  • Firewall-protected servers and secure network configurations
  • Tokenized authentication for user sessions
  • Secure password hashing using bcrypt or equivalent standards
  • Secure API communication with Stripe, Plaid, Apple, and internal services
  • Monitoring, logging, and vulnerability scanning

6.2 Access Controls

StepShake restricts access to personal information to authorized employees, contractors, or service providers who need access to operate, secure, or improve the Service. We use role-based access controls, least-privilege access rules, audit logs, and access revocation procedures.

6.3 Account Security

You are responsible for safeguarding your login credentials and verification codes. You should not share passwords or codes with anyone. If unusual account activity is detected, we may temporarily suspend access, request additional verification, or notify you.

6.4 Payment & Identity Security

We do not store full payment card numbers or bank credentials. Stripe manages payment details, Plaid manages identity verification and bank connectivity, and Apple manages App Store billing independently of StepShake.

6.5 Data Storage & Hosting Protections

Your information may be stored on secure cloud servers operated by trusted third-party providers. We may use automated backups, redundant storage systems, and protections against accidental data loss.

6.6 Breach Response

In the event of a data breach, StepShake will investigate promptly, take action to secure systems, notify affected users when required by law, and provide guidance where appropriate.

6.7 User Responsibilities

Users agree to keep account information up to date, protect their devices from unauthorized access, use official StepShake app downloads only, and report suspicious activity to support@stepshake.com.

6.8 No Guarantee

No method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security, but we commit to using reasonable industry-standard safeguards.

7. Data Retention

StepShake retains information only as long as necessary to fulfill the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, maintain security, and enforce our Terms & Conditions.

7.1 Personal Information

We retain personal information, including name, email, phone number, profile photo, account details, and settings, for as long as your account remains active. If you delete your account, personal data is scheduled for deletion within 30–90 days, backups may take up to 180 days to fully cycle out, and some metadata may remain longer where required by law.

7.2 Activity & Usage Data

Steps, distances, group interactions, club activity, paths, messages, invitations, check-ins, live stream records, highlights, content purchases, and payout activity are retained while your account is active. After account deletion, activity data is deleted or anonymized within 30–180 days, except where retention is legally required or needed for fraud prevention.

7.3 Device & Technical Logs

Device information, crash reports, diagnostics, and performance logs are generally stored for 90–365 days, or longer if needed for security, troubleshooting, or fraud prevention.

7.4 Financial & Verification Data

StepShake does not retain financial credentials. Plaid, Stripe, Stripe Connect, and Apple may retain information according to their own legal, security, and compliance requirements. StepShake stores limited payment references, verification status, payout status, and compliance metadata as needed.

7.5 Tax & Compliance Records

For users who participate in club-owner payouts, creator payouts, content-sale payouts, or other earning features, U.S. W-9 and 1099-related information may be retained for seven years or as otherwise required by law. International tax data is retained only for the minimum duration required by applicable law.

7.6 Suspended or Fraudulent Accounts

If StepShake detects fraud, abuse, safety violations, fake steps, payout manipulation, content-purchase abuse, or multi-account activity, we may retain certain information indefinitely for security and fraud-prevention purposes.

7.7 Backups

Data stored in secure backups may persist for up to six months after deletion but is encrypted, restricted, and not used for active app functionality.

7.8 Anonymized & Aggregated Data

We may retain anonymized or aggregated data indefinitely for analytics, performance improvements, feature development, statistical reporting, and business planning. This data cannot identify you personally.

8. Children’s Privacy

StepShake is not intended for individuals under the age of 18, and we do not knowingly collect, store, or process personal information from anyone under 18. By using the Service, you confirm that you are at least 18 years old or the age of majority in your jurisdiction if higher.

We do not allow minors to create accounts, participate in payout programs, access identity verification or financial features, purchase club content, or join in-person meetups organized through the app.

If we discover that a user under 18 has created an account, we will suspend the account, delete collected information where required, and block further access to the Service.

9. Your Rights

Depending on where you live, you may have privacy rights under laws such as GDPR, UK GDPR, CCPA/CPRA, PIPEDA, and other regional regulations.

9.1 Right to Access

You may request a copy of the personal information we hold about you, details about how it is used, and information about third-party services that process your data.

9.2 Right to Correction

You may request correction of inaccurate, incomplete, or outdated account, identity, tax, payout, club, or purchase information.

9.3 Right to Deletion

You may request deletion of your personal data, including account information, activity history, messages, and preferences, except where retention is required for fraud prevention, tax compliance, financial reporting, legal obligations, or dispute records.

9.4 Right to Withdraw Consent

Where processing is based on consent, such as location access, health data, camera access, microphone access, or marketing emails, you may withdraw consent by adjusting app settings, device permissions, or contacting support.

9.5 Right to Restrict Processing

You may request that we limit use of your data where legally applicable. Certain app features may not function during restriction.

9.6 Right to Data Portability

You may request an electronic export of profile information, step/activity data, club activity, purchase records, payout records, or other structured data you provided.

9.7 Right to Object

You may object to marketing communications, certain profiling or analytics, or processing based on legitimate interest where applicable.

9.8 California Privacy Rights

California residents may request categories of data collected, categories of data disclosed, correction, deletion, access, opt-out of certain sharing, and limits on the use of sensitive personal information. StepShake does not sell personal data.

9.9 GDPR & UK GDPR Rights

EU and UK users may have rights under GDPR Articles 12–23, including the right to lodge a complaint with a Data Protection Authority and to request information about any applicable representative.

9.10 How to Exercise Your Rights

To submit a privacy request, contact privacy@stepshake.com with the subject line Data Request – StepShake. Include your full name, the email associated with your account, and a description of your request. We may verify your identity before processing your request.

Most requests are processed within 30 days for GDPR regions, 45 days for CCPA/CPRA requests, or sooner where possible.

9.11 No Discrimination

StepShake will not deny service, charge different prices, or offer different functionality because you exercised your privacy rights, except where a feature cannot reasonably function without the requested data.

10. Updates to This Policy

We may update this Privacy Policy from time to time to reflect changes in services, legal requirements, data practices, security improvements, or app functionality. We may notify you by posting the updated policy in the app, updating the Last Updated date, sending an in-app notification, or sending an email where required by law.

Unless otherwise stated, updated policies take effect immediately upon posting. If you do not agree to the updates, you must discontinue use of the Service and delete your account.

Part II – StepShake Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of StepShake, StepN’Talk, and related websites, apps, features, subscriptions, clubs, messaging, events, rewards, and services.

1. Acceptance of Terms

By creating an account, accessing, or using StepShake, StepN’Talk, or related services, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to use the Service.

2. Accounts

You may create only one account per person. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

We may suspend, restrict, or terminate accounts for fraud, abuse, safety concerns, policy violations, suspicious activity, payment issues, or legal compliance reasons.

3. Subscriptions and Pro Membership

StepShake may offer a Pro subscription at $300 per month, unless another price is shown at checkout. Subscriptions may be processed through Apple In-App Purchases, Stripe, or other approved billing providers.

  • Subscriptions automatically renew unless canceled before the renewal date.
  • Apple subscriptions must be canceled through the App Store.
  • Stripe or web subscriptions may be canceled through account settings or support where available.
  • Access to paid features continues through the paid subscription period unless otherwise required by law.
  • Refunds follow Apple, Google, Stripe, or applicable payment-provider rules unless required by law.
  • Pro benefits, including creating Step Clubs, club-owner tools, analytics, creator tools, and payout eligibility, require an active subscription unless stated otherwise. Pro members may also join other clubs, subject to each club’s membership terms and availability.

4. Club Owner Earnings, Creator Payouts & Content Sales

StepShake may offer club-owner support payouts, creator revenue, club content sales, business rewards, or similar earning features. Earnings are not guaranteed and depend on the applicable club, subscription, purchase, payout, verification, and program rules.

  • Club-owner support payout: eligible club owners may receive a $150 monthly support payout for each qualifying paying Pro member/customer assigned to or participating in their club, subject to verification, active subscription status, eligibility, fraud review, and any applicable hold period.
  • Different clubs may have different payout arrangements, pricing, member-fee structures, or content revenue terms. StepShake may update payout rules, eligibility, or amounts with notice where required.
  • Rewards may be modified, suspended, capped, delayed, or terminated with notice where required.
  • Taxes are your responsibility. U.S. users may be required to submit a W-9, and StepShake may issue a 1099-NEC or 1099-MISC where thresholds apply.
  • Payouts may require Plaid identity verification, tax information where required, and a valid Stripe Connect account or other approved payout method.
  • Fake memberships, fake customers, fake subscriptions, payout manipulation, fake steps, GPS manipulation, bots, duplicate accounts, device farms, or content-purchase abuse may void earnings and may result in suspension.

5. Step Clubs, Groups, Paths & User-Generated Content

Step Club owners, admins, and users are responsible for the content they publish, upload, stream, sell, or share, including live videos, video store content, paid videos, highlights, group paths, posts, comments, chats, media, business listings, and event descriptions.

Pro members may create and manage Step Clubs. Pro members may also join other clubs, subject to each club’s rules, pricing, and availability. A Pro member may own or manage multiple clubs, and payout terms may vary by club, customer/member type, content type, or program rules.

Users may create groups, follow groups, follow group paths, view available highlights, upload eligible highlights where permitted, and interact with community features according to the permissions available to their account.

Club owners may offer videos, highlights, training content, fitness content, or other club-created content for purchase. Users may be able to purchase paid club content even if they are not a member of that club and even if they do not have a Pro account, unless the content owner or StepShake requires otherwise for a specific item.

By uploading or posting content, you grant StepShake a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, transmit, distribute, make available, sell access to, modify for technical formatting, and use the content solely to operate, monetize, promote, secure, and improve the Service.

We may remove content or restrict accounts that violate these Terms, community guidelines, intellectual property rights, safety rules, payment rules, or applicable law.

6. Groups, Meetups & Safety

Groups, Step Clubs, group paths, events, walks, business visits, and in-person meetups are at your own risk. StepShake does not guarantee participant identity, safety, conduct, availability, or fitness level.

You agree to follow local laws, use reasonable judgment, meet in safe public places, and avoid harassment, illegal activity, dangerous conduct, threats, or abuse.

7. Businesses & Walk-to-Earn

Business listings, promotions, check-ins, and offers must be accurate and lawful. Check-ins must reflect genuine visits. Partner rewards are subject to business terms, availability, verification, fraud review, and program limits.

StepShake may remove inaccurate business listings, deny fraudulent check-ins, and suspend reward eligibility for misuse.

8. Live Streaming

You must have all necessary rights and permissions for any content you stream, record, upload, or save as highlights. You may not broadcast illegal, harmful, private, infringing, abusive, sexually explicit, hateful, violent, or dangerous content.

StepShake may interrupt live sessions, remove recordings, disable highlights, or suspend accounts for violations.

9. Prohibited Conduct

You agree not to:

  • Create fake steps or manipulate activity data
  • Use bots, scripts, emulators, device farms, or automation to earn rewards
  • Create fake club memberships, fake customers, fake subscriptions, or multi-accounting schemes
  • Impersonate another person or business
  • Harass, threaten, stalk, abuse, or exploit other users
  • Scrape, crawl, copy, reverse engineer, or interfere with the Service
  • Circumvent subscriptions, paywalls, payout limits, verification systems, or security controls
  • Upload malware, spam, illegal content, or infringing material
  • Use the Service for unlawful, unsafe, deceptive, or harmful activity

10. Health, Fitness & Activity Disclaimers

StepShake is not medical advice, fitness advice, or a substitute for professional healthcare guidance. Walking, exercise, meetups, and physical activity involve risk. You are responsible for determining whether participation is safe for you.

Activity tracking depends on device sensors, Apple Health, Android data, GPS, user permissions, and third-party systems. Step counts, distances, rankings, and rewards may not always be accurate or available.

11. Payments, Refunds & Chargebacks

Paid features, subscriptions, club fees, video purchases, and other transactions may be processed through Apple, Stripe, Stripe Connect, or other approved providers. You agree to provide accurate billing information and authorize applicable recurring charges.

Refunds are subject to the rules of the payment provider and applicable law. Chargebacks, payment failures, or suspected payment abuse may result in suspension or loss of paid features.

12. Intellectual Property

StepShake, StepN’Talk, logos, designs, software, features, text, graphics, interfaces, and related materials are owned by StepShake or its licensors and are protected by intellectual property laws.

You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the Service except as expressly allowed by law or written permission.

13. Third-Party Services

The Service may integrate with Apple, Google, Plaid, Stripe, Stripe Connect, analytics tools, cloud providers, maps, notification services, or other third-party platforms. Your use of those services may be governed by their own terms and privacy policies.

StepShake is not responsible for third-party services, outages, data practices, or policies.

14. Suspension and Termination

We may suspend, restrict, or terminate your account or access to features if we believe you violated these Terms, created risk, engaged in fraud, failed verification, caused payment issues, or used the Service unlawfully.

You may stop using the Service at any time and may request account deletion according to our Privacy Policy.

15. Disclaimers

The Service is provided “as is” and “as available.” StepShake does not guarantee that the Service will be uninterrupted, error-free, secure, accurate, or available at all times. We do not guarantee earnings, club-owner payouts, content sales, business results, club growth, social outcomes, fitness results, or meetup safety.

16. Limitation of Liability

To the maximum extent permitted by law, StepShake, its owners, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, lost rewards, personal injury, or business losses.

Where liability cannot be excluded, StepShake’s maximum liability is limited to the amount you paid to StepShake during the 12 months before the claim, or $100, whichever is greater, unless applicable law requires otherwise.

17. Indemnification

You agree to defend, indemnify, and hold harmless StepShake and its affiliates from claims, damages, liabilities, costs, and expenses arising from your use of the Service, your content, your violation of these Terms, your violation of law, or your infringement of another person’s rights.

18. Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, unless another jurisdiction is required by law.

Any dispute will be handled in the state or federal courts located in California, unless arbitration, small claims court, or another process is required by applicable law or added in a future updated version of these Terms.

You should consult legal counsel to confirm the correct governing law, arbitration language, venue, and consumer-rights disclosures for your business.

19. Changes to These Terms

We may update these Terms from time to time. Updates may be posted in the app, on our website, or sent by email or in-app notice where required. Continued use of the Service after updates become effective means you accept the updated Terms.
